Senior Litigation Law Clerk (Commercial & Franchise)

The Firm
Law Works is a specialized litigation boutique handling franchise and commercial disputes and arbitrations across multiple provinces. We operate a commercial litigation practice that requires high standards of procedural experience and digital evidence management.

The Role
This is a senior position for a clerk who will take primary responsibility for the procedural and evidentiary management of our files. You will work directly with the principal and associates to ensure all litigation steps are carried out properly and that digital evidence is managed effectively throughout the litigation lifecycle.

Key Responsibilities

  • Procedural Management: Navigate and apply the Rules of Court in Ontario, BC, and Alberta. Handle complex filings and maintain the procedural schedule for all active files.
  • E-Discovery & Evidence Management: Manage the identification, collection, and organization of electronic evidence. This includes overseeing the production process, managing document metadata, and preparing electronic briefs for motions/applications, trials, arbitrations and appeals.
  • Document Drafting: Draft pleadings, documents lists, and bills of costs with minimal supervision.
  • Timetable Oversight: Monitor and ensure strict compliance with all court and internal deadlines.

Requirements

  • Experience: 5+ years of experience as a Litigation Clerk. Previous experience in commercial or franchise litigation is preferred.
  • E-Discovery Competence: Practical experience with the e-discovery lifecycle. You should be comfortable managing data from collection through to production.
  • Procedural Mastery: Strong mastery of the Ontario Court Rules. Proven ability to quickly learn and apply the rules of other Canadian jurisdictions is essential.
  • Technical Skills: High proficiency with Adobe Acrobat Professional and Microsoft Word (including advanced formatting). Experience with litigation support software is an asset.
  • Attention to Detail: A disciplined approach to document indexing, file organization, and proofreading.
  • Credentials: Law Clerk diploma or ILCO certification.

  • Work Model: Hybrid work model for GTA-based candidates.

Mandatory Requirements

  1. Experience: Must have 2-5 years of post-call experience focused on Commercial Litigation, gained within a Canadian jurisdiction.
  2. License: Must be a member in good standing of the Law Society of Ontario (LSO) or another Canadian Provincial Law Society. Applications from non-Canadian jurisdictions or those without Canadian litigation experience will not be considered.
  3. Skills: Demonstrated superior ability in critical analysis and persuasive legal writing.
  4. Fit: Eagerness to develop deep expertise in franchise and commercial litigation and arbitration (prior franchise experience is not required).

Key Responsibilities

  • Drafting complex court materials, including pleadings, affidavits, motion materials and written arguments (factums).
  • Contributing to high-level case strategy and development.
  • Managing document discovery and e-discovery processes.
