On October 7, 2013, Law Times quoted Ben Hanuka in its weekly cover story on an Ontario case about law firm client confidentiality. In the decision, the court rules that lawyers practicing in an association are not presumed to be part of a law firm for purposes of maintaining client confidentiality and avoiding conflicts of interest.
Ben Hanuka was quoted criticizing the court’s reasoning for using dangerous reasoning and “drawing a broad stroke”. In Ben’s opinion, lawyers practicing in association and who hold themselves out as part of a single law firm must maintain high standards of client confidentiality and conflict of interests, and are presumed to share client information.
